Terms of Service

1. Who we are

KOVA ("KOVA", "we", "us") operates a mobile-first traveler community network organized around Coves — invite-based communities run by Creators. These Terms form the agreement between you and KOVA for your use of the KOVA website, app, and related services (together, the "Service").

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use KOVA. You may not use the Service if we've previously suspended or removed your account, unless we've given you written permission to return.

3. Your account

You must provide accurate information at signup and keep your credentials secure. You are responsible for activity that happens under your account, including content you post and actions your linked integrations take on your behalf. Notify us promptly if you suspect unauthorized access.

4. Coves & communities

Coves are community spaces run by Creators. Membership, invites, events, announcements, and pricing inside a Cove are governed by that Cove Creator's guidelines in addition to these Terms. Creators may set additional rules, collect dues through our payments partner, and remove members who violate their standards. KOVA is not a party to the agreement between you and a Cove Creator, but we can remove content or accounts that violate these Terms.

5. Location, proximity & privacy

KOVA is a location-aware product. You control whether you share your location and can toggle Off-Grid or update your pin at any time. Approximate location is used to power the map, proximity pings, and Cove features. See the Privacy Policy for what we collect and how we use it.

6. Acceptable use

You agree not to:

• Harass, threaten, defraud, stalk, dox, or endanger other members.
• Post content that is unlawful, hateful, sexually exploitative, or infringing.
• Impersonate another person or misrepresent your affiliation with a Cove.
• Scrape, crawl, or bulk-export member data, messages, or location signals.
• Bypass Cove access controls, invite gating, rate limits, or security features.
• Use the Service to send unsolicited commercial messages or to recruit members to a competing platform.
• Interfere with the Service, upload malware, or probe for vulnerabilities without authorization.

7. Your content

You keep ownership of the content you post — profile info, photos, messages, event details, and announcements. You grant KOVA a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and improve the Service, including sharing it with the Coves and members you direct it to. You represent that you have the rights to post what you post.

8. Events, payments & refunds

Some Coves host paid events. Payments are processed by our third-party payments partner. Refunds, cancellations, and no-show policies are set by the event host or Cove Creator and disclosed at checkout. KOVA is not responsible for what happens at in-person events; you attend at your own risk and are responsible for your own safety, transportation, insurance, and gear.

9. Third-party integrations

KOVA may integrate with third-party services such as messaging groups, video conferencing, mapping providers, and authentication providers. Your use of those services is governed by their own terms. We are not responsible for third-party services or the content they host.

10. Intellectual property

The KOVA name, logo, and Service (excluding user content) are owned by KOVA and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

11. Reporting & takedowns

To report abuse, safety concerns, or content that infringes your rights, contact us through the in-app support link. We review reports and may remove content, suspend accounts, or contact law enforcement where appropriate.

12. Suspension & termination

We may suspend or remove accounts that violate these Terms, a Cove's rules, or applicable law, or that create risk for other members. You may delete your account at any time from Settings. Some content (for example, messages you sent to others) may persist in other members' views after deletion.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. KOVA does not warrant that the Service will be uninterrupted, secure, or error-free, or that location data or member information will be accurate.

14. Limitation of liability

To the fullest extent permitted by law, KOVA and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the Service. KOVA's total liability for any claim relating to the Service is limited to the greater of the amounts you paid KOVA in the twelve months before the claim, or one hundred U.S. dollars.

15. Indemnification

You agree to defend and indemnify KOVA against claims and expenses arising from your content, your use of the Service, or your violation of these Terms.

16. Changes to the Service or Terms

We may update the Service and these Terms as the product evolves. If we make material changes, we'll notify active members through the app or by email. Continued use of KOVA after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the United States and the state of the KOVA operating entity, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless local law requires otherwise.
